The California Court of Appeal dismissed a lawsuit by an anonymous woman who claimed the Food and Drug Administration (FDA) illegally approved her prescription of Viagra.
The plaintiff in the suit claimed the FDA improperly promoted her for Viagra, then sold her generic version of Viagra on the Internet without adequate warnings or guidance from the FDA’s medical advisory committee.
The plaintiff alleged the FDA improperly allowed the drugmaker to prescribe the drug without the knowledge of the agency or the patient, and then withheld information about the drug’s potential side effects and interactions. She said the information was not provided to the public and “was meant to influence public health, but it was withheld to conceal” the drug’s safety issues.
“The FDA is the ultimate authority” with respect to the safety and efficacy of Viagra, according to the lawsuit.
The FDA also issued a warning about the drug’s use for erectile dysfunction. It was alleged that the FDA had improperly determined that the drug’s side effects included symptoms such as headache, flushing, and back pain, while it did not warn that the drug could cause heart problems and stroke.
